Scottsdale STR Regulatory and HOA Risk

Arizona SB 1350 (2016) preempts municipal short-term rental bans, but the City of Scottsdale requires STR registration (annual fee, designated emergency contact). SB 1168 (2024) added verification requirements. Critically, SB 1350 does NOT override private HOA contracts: several Scottsdale communities (most of Troon, parts of Desert Mountain, several DC Ranch and Gainey Ranch sub-HOAs) prohibit STR use entirely. Future regulatory changes (state or municipal) may affect whether a property currently used as an STR can continue to operate as one. We assume conservative 5-year hold periods in our advisory ranges, but we do not warrant any representation about the legality, permitting status, HOA compatibility, or future viability of any specific Scottsdale STR property.
